Buffr operates a lead marketplace that connects people looking for auto detailing services with independent detailing businesses. Buffr sells access to leads, not detailing services. Independent detailers set their own prices, schedules, and warranties and are responsible for their work.
By using Buffr’s website, forms, communications, or partner platform, you agree to these Terms, including mandatory arbitration and a class-action waiver.
1. ACCEPTANCE OF TERMS
By accessing or using Buffr’s websites, forms, communications, or partner platform, you agree to be bound by these Terms of Service and all incorporated policies. If you do not agree, do not use Buffr.
2. MARKETPLACE ROLE
Buffr, LLC operates a lead marketplace.
– Buffr sells access to customer leads.
– Buffr does not provide detailing or automotive services.
– Buffr is not a party to any agreement between customers and independent detailers.
– Buffr does not set prices, schedules, or warranties.
– Independent detailers are solely responsible for their services, conduct, and compliance with law.
3. CUSTOMER RESPONSIBILITIES
Customers agree to:
– Provide accurate and current contact and service information.
– Grant express written consent to be contacted by Buffr and up to three independent detailing businesses regarding the request.
– Understand that price ranges shown are informational only and not final quotes.
– Resolve service-related disputes directly with the independent detailer.
4. PARTNER RESPONSIBILITIES (INDEPENDENT CONTRACTORS)
Partners using Buffr agree that:
– They are independent contractors, not employees, agents, or representatives of Buffr.
– They control pricing, scheduling, workmanship, warranties, and customer contracts.
– They must meet Buffr’s eligibility requirements before receiving leads, including:
– Active insurance coverage where required
– Stripe Connect onboarding with charges_enabled and payouts_enabled
– Acceptance of Buffr policies
– Maintaining at least Bronze tier status
– Buffr may pause or disable routing for non-compliance.
5. CONSENT & COMMUNICATIONS
– Express written consent is required before outreach.
– Buffr logs consent artifacts including timestamp, IP address, page, form version, and consent text hash.
– Outreach is limited to 8:00am–8:00pm local time.
– Opt-outs using STOP, END, QUIT, or UNSUBSCRIBE are honored within 60 seconds across all channels.
– Buffr scrubs leads against Do Not Call registries before outreach and periodically thereafter.
6. PAYMENTS & FEES
– Buffr does not process payments between customers and detailers.
– Partners pay Buffr for lead access as disclosed in the partner platform.
– Partner payouts, where applicable, are facilitated through Stripe Connect.
– Buffr does not store raw tax or identity documents and stores only payout eligibility statuses.
7. LEAD QUALITY, CREDITS & REFUNDS
– Buffr sells lead access, not guaranteed jobs.
– Credits may be issued for invalid contact information, verified consent errors, or duplicate leads in accordance with Buffr’s Refund/Credit Policy.
– Credits are the primary remedy. Refunds are rare and issued only when required by law or for confirmed systemic errors.
– Service quality, pricing disputes, no-shows, or customer preferences are not eligible for credits.
8. INTELLECTUAL PROPERTY
All Buffr content, trademarks, logos, software, and platform materials are owned by Buffr or its licensors. Users may not copy, modify, distribute, or exploit Buffr intellectual property without written permission.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
– Buffr is not liable for service quality, damages, injuries, or losses arising from services provided by independent detailers.
– Buffr’s total liability for any claim will not exceed the amount paid to Buffr by the user in the three (3) months preceding the event giving rise to the claim.
– Buffr is not liable for indirect, incidental, special, consequential, or punitive damages.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Buffr, LLC from any claims, damages, losses, or expenses arising from:
– Your use of the platform
– Your services or conduct (for partners)
– Your violation of these Terms or applicable law
11. TERMINATION
– Buffr may suspend or terminate access for violations, non-compliance, risk, or legal requirements.
– Users may stop using Buffr at any time.
– Upon termination, you must stop using any lead data except as required by law.
12. GOVERNING LAW
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
13. ARBITRATION AGREEMENT
Any dispute arising out of or relating to these Terms or your use of Buffr shall be resolved by binding arbitration administered in Maricopa County, Arizona, rather than in court.
The arbitration will be conducted on an individual basis only.
14. CLASS-ACTION WAIVER
YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
15. WAIVER OF JURY TRIAL
YOU AND BUFFR EACH WAIVE THE RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.
16. CHANGES TO TERMS
Buffr may update these Terms at any time by posting a revised version. Continued use of Buffr after the effective date constitutes acceptance.
17. ENTIRE AGREEMENT
These Terms, together with incorporated policies (Privacy Policy, Refund/Credit Policy, Partner Policies), constitute the entire agreement between you and Buffr regarding use of the platform.
